These Terms of Service (“Terms”, “Terms of Service” or “Terms & Conditions”) govern your access to and use of The House of Marbella website, online store, products, content, features, tools and related services (collectively, the “Services”).
Throughout these Terms, the terms “The House of Marbella”, “MarBella”, “we”, “us” and “our” refer to the business operating The House of Marbella.
Our online store is powered by Shopify, which provides the e-commerce infrastructure that enables us to offer our products and Services.
The terms “you”, “your”, “user” and “customer” refer to any person who visits our website, places an order, purchases a product, creates an account or otherwise uses our Services.
Please read these Terms carefully before accessing our website or purchasing any product.
By accessing our website, creating an account, placing an order or otherwise using our Services, you acknowledge that you have read and agree to these Terms, subject to any rights that cannot be waived under applicable law.
If you do not agree with these Terms, you should not use the Services.
1. ELIGIBILITY
By using our Services or placing an order, you represent that you are legally capable of entering into a binding transaction under applicable law or are using the Services under the supervision and with the permission of a parent or lawful guardian where permitted.
You agree not to use our products or Services for any unlawful or unauthorised purpose.
2. OUR PRODUCTS
The House of Marbella specialises in products made from natural marble, natural stone and other premium materials, many of which are handcrafted, hand-finished or produced using artisanal processes.
Because of the natural and handcrafted nature of our products, each individual piece may be unique.
No two pieces of natural marble are guaranteed to be identical.
Natural and handcrafted variations may include differences in:

Colour;

Shade;
-
Pattern;
-
Texture;
-
Mineral deposits;
-
Crystallisation;
-
Natural markings;
-
Pores;
-
Small pits;
-
Fissures;
-
Dimensions;
-
Shape;
-
Edge finishing;

Polish; and
-
Other naturally occurring or handcrafted characteristics.
Reasonable variations of this nature are inherent characteristics of natural and handcrafted products and will not ordinarily constitute manufacturing defects.
3. PRODUCT IMAGES & COLOURS
We make reasonable efforts to display our products accurately.
However, product photographs are intended to provide a reasonable representation of the product's overall design and appearance.
The actual product may vary from photographs because of:

Natural marble variation;

Individual stone characteristics;

Lighting conditions;

Photography;
-
Image processing;
-
Device screens;
-
Display settings;
-
Handcrafting; and

Differences between individual pieces of natural stone.
Accordingly, we cannot guarantee that the marble veining, pattern, colour distribution or natural markings of the product you receive will be identical to the piece shown in a photograph.
Reasonable natural variations are part of the individuality of marble and do not ordinarily mean that an incorrect product has been supplied.
4. PRODUCT DIMENSIONS
We endeavour to provide reasonably accurate product measurements.
However, because many products are handcrafted or made from natural stone, minor variations in dimensions may occur.
Dimensions displayed on our website should therefore be understood as approximate unless expressly stated otherwise.
Customers should review product dimensions carefully before ordering, particularly where a product is intended to fit within a specific space.
5. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, materials, dimensions, prices and other information displayed on our website are accurate.
However, occasional typographical, technical or administrative errors may occur.
If we discover a material error relating to a product or order, we may contact you to correct the error or provide appropriate options before fulfilment.
Nothing in these Terms permits us to misrepresent the characteristics of products or removes any mandatory consumer rights.
6. PRICES
All product prices will be displayed on our website in the applicable currency.
Prices may be changed from time to time without prior notice for future orders.
Changing the listed price of a product will not ordinarily alter the agreed price of an order that we have already accepted, except where there is an obvious pricing or technical error and applicable law permits correction.
Shipping, delivery and other applicable charges may be displayed separately at checkout or otherwise communicated before completion of the transaction.
Applicable taxes will be handled in accordance with applicable law.
7. ORDERS
Placing an order through our website constitutes an offer to purchase the selected product(s).
Receipt of an automated order confirmation does not necessarily mean that an order has been finally accepted for fulfilment.
Orders may be subject to:

Where we cancel a prepaid order before fulfilment and the customer is entitled to reimbursement, the applicable amount will be refunded in accordance with applicable law.
9. PAYMENT
Orders must be paid through the payment methods made available on our website.
Payments may be processed by independent third-party payment gateways, banks, card networks, UPI providers or other financial institutions.
The House of Marbella generally does not directly store complete card numbers, CVV numbers, UPI PINs, banking passwords or similar authentication credentials where such credentials are entered directly into the secure environment of a payment provider.
Your use of a payment service may also be subject to the terms and privacy practices of the applicable provider.
10. PAYMENT FAILURE
An order may not be processed if payment is unsuccessful, declined, reversed, incomplete or cannot be verified.
If money appears to have been deducted but the order was not successfully confirmed, please contact us and, where appropriate, the applicable bank or payment provider.
Processing times for failed or reversed transactions may depend upon the relevant bank or payment provider.
11. FRAUD PREVENTION
We reserve the right to take reasonable measures to protect our customers and business against fraud.
Where an order appears suspicious, fraudulent, unauthorised or abusive, we may, subject to applicable law:

Providing false information or knowingly attempting to make an unauthorised transaction may result in cancellation of the order and other appropriate action.
12. SHIPPING & PROCESSING
Our products include handcrafted natural-marble pieces that require inspection and specialised protective packaging.
For this reason, please allow a minimum of 3 business days after order confirmation for processing, quality inspection, packing and preparation for dispatch.
This is the processing period and does not include courier transit time.
Total fulfilment time consists of:
Processing Time + Courier Transit Time
During festive seasons, sales, promotional events and unusually high-volume periods, processing and delivery may take slightly longer.
Customers placing time-sensitive or gifting orders should therefore order sufficiently in advance.

13. DELIVERY ESTIMATES
Delivery dates communicated through our website, courier tracking or customer support are estimates unless expressly guaranteed.
Delivery may be affected by circumstances including:

Transportation disruptions;

Public holidays;

Festive seasons;

Strikes;

Natural disasters;

Nothing in this section removes any right available to a customer under mandatory applicable law concerning delivery.
14. CUSTOMER SHIPPING INFORMATION
Customers are responsible for providing complete and accurate:

Telephone number; and
-
Other information reasonably necessary to complete delivery.
If you discover an error after placing an order, contact us immediately.
We cannot guarantee that an address can be changed once an order has been processed or dispatched.
To the extent permitted by law, we are not responsible for consequences caused solely by inaccurate or incomplete information supplied by the customer.
15. FAILED DELIVERY & RETURN TO ORIGIN
If delivery fails because of:

Incorrect/incomplete address;

Customer unavailability;

Customer refusing delivery without an eligible reason;

Customer being unreachable; or

Another circumstance attributable to the customer,
the shipment may be returned to us.
Where legally permissible, the customer may be responsible for applicable:

Forward shipping charges;

Return-to-origin charges; and

Re-shipping charges.
If the customer requests another delivery attempt after the shipment returns to us, applicable shipping charges may be required before re-dispatch.
16. RETURNS & REFUNDS
Our return and refund terms are governed by our separate Return, Refund & Exchange Policy, which forms part of these Terms.
As a general policy, we do not accept returns or refunds merely because of:

Change of mind;

Personal preference;

Natural marble variation;
-
Minor handcrafted variation; or
-
Customer ordering an incorrect eligible product/size/design.
However, nothing in these Terms or our policies limits remedies that must be provided under applicable consumer law for goods that are defective, deficient, spurious, materially not as advertised/agreed or otherwise subject to a mandatory statutory remedy.
17. EXCHANGES
Eligible full-priced products may be exchanged subject to the requirements contained in our Return, Refund & Exchange Policy.
For normal customer-requested exchanges, the customer is responsible for:
1. Reverse Shipping Charges — shipping the original product back to The House of Marbella; and
2. Forward/Re-Shipping Charges — shipping the replacement product to the customer.
The replacement may be dispatched only after the original product has been received and inspected and applicable charges and price differences have been paid.
Discounted, sale, clearance, promotional and final-sale products are not eligible for normal customer-requested exchanges, except where mandatory applicable law requires a remedy.
18. DAMAGED OR INCORRECT PRODUCTS
If you receive a product that is materially damaged/broken during delivery or receive a materially incorrect product/SKU, you must contact us within 48 hours (2 days) of recorded delivery to initiate our claims process.
Customers should provide:

Complete uninterrupted unboxing video;

Clear photographs;
-
Photographs of packaging where relevant; and
-
Description of the issue.
Claims are subject to verification and applicable law.
19. UNBOXING VIDEO
Because marble products are fragile and may pass through multiple logistics stages, customers are strongly instructed to record a complete and uninterrupted unboxing video.
For a damage/breakage or incorrect-product claim, the video should:

Begin before the shipping package is opened;

Show the package in its sealed condition;
-
Show the shipping label where reasonably visible;
-
Show the complete opening process;
-
Be continuous and unedited;
-
Show the product being removed; and
-
Clearly show the claimed damage or incorrect product.
A claim may be rejected where adequate evidence of the alleged transit damage or incorrect delivery is not provided, subject always to mandatory applicable consumer law.
20. DISCOUNT CODES & PROMOTIONS
From time to time, The House of Marbella may offer:

Discount codes;

Promotional offers;
-
Sale prices;
-
Bundle offers;
-
Welcome offers;
-
Limited-time promotions; or
-
Other benefits.
Promotions may be subject to separate conditions.
Unless expressly stated otherwise:

Discount codes cannot be combined;

Discounts have no cash value;

Discounts cannot be retrospectively applied to completed orders;

Promotional eligibility may be limited;

Offers may have expiry dates;
-
Offers may be limited to specified products or order values; and

Promotional offers may be withdrawn or modified for future orders.
We reserve the right to cancel or refuse a discount obtained through fraud, manipulation, technical exploitation or violation of promotional terms.

is owned by, licensed to or lawfully used by The House of Marbella and is protected by applicable intellectual-property laws.
Nothing on our website grants you ownership of our intellectual property.
22. PROHIBITED USE OF OUR CONTENT
Without our prior written permission, you may not, except where permitted by law:

We will not be responsible for losses caused solely by:

Nothing contained in these Terms is intended to exclude, restrict or waive any consumer protection, statutory guarantee, legal remedy or other right that cannot lawfully be excluded, restricted or waived under applicable law.
